If you were hurt in a car accident, truck accident or on someone's property while on-the-job you probably know that Colorado workers' compensation benefits are available.  Under Colorado law, workers' compensation benefits usually provide for a portion of your lost wages and pay medical expenses. You might not know, however, that you probably also have a right recover your unpaid wage loss and for personal injuries.

Some workers are afraid if they obtain a workers compensation attorney they will loose their job.  Because Colorado has employment-at-will an employer can generally fire an employee for any reason, as long as it is not an illegal reason.  It would be illegal to fire an employee simply because he or she hired an attorney to pursue a workers compensation claim.  However, in the real world, no employer will state that is why you are fired.  As such, we at understand any apprehension you may have in hiring a workers compensation attorneyRest assured, we will not take that case!

Do I really need a workers' compensation attorney?

Some workers compensation benefits are automatic.  It makes no sense to pay an attorney for benefits you would have received anyway.  In fact, under Colorado law, a workers' compensation attorney is only permitted to obtain an attorney’s fee on disputed benefits.  If you are being treated fairly by your employer and the workers compensation insurer, you may not need an attorney right away.  Generally, attorneys are necessary if you are being denied treatment, being sent back to work too soon or have been given a permanent impairment rating that is too low.  An attorney may also be necessary if your wages have not been calculated properly or if the insurer denies the fact that you were working or the extent of your injuries.

However, workers compensation laws in Colorado do not compensate you for things such as lost earning capacity, pain and suffering, inconvenience or emotional distress.  Workers compensation benefits for injured Colorado workers include only partial wage loss and sometimes a disability payment.  However, many of these benefits do not fully compensate an injured worker.  In fact, workers compensation benefits in Colorado never fully reimburse the injured worker's wage loss.  What about the unpaid wage loss and other damages or losses?
